Creator End User License Agreement

Terms governing use of the Foodie platform and participation in collaborations offered to creators.

By creating a creator account, accessing Foodie, or accepting an invitation, you agree to this Agreement. If you do not agree, do not use the platform or any invitation offered through it.

1. Purpose and applicable documents

This Agreement governs Creators' use of the Foodie.ma platform, its related features, and invitations to collaborate with partner restaurants (collectively, the “Platform”).

It supplements Foodie's Terms of Service. If there is a conflict, this Agreement controls matters specific to Creators and Campaigns. The specific terms shown in a Campaign—including the restaurant, date, deliverables, required disclosures, any benefits, and publication deadline—form an integral part of this Agreement.

2. Eligibility and account

The Foodie Creator Program is available only to adults at least 18 years old who reside in Morocco or create content in Morocco.

  • You must provide accurate, complete, and current information.
  • You must protect your login credentials and remain responsible for activity conducted through your account.
  • You must maintain an authentic, active Instagram and/or TikTok account that complies with the applicable platform's rules.
  • You must promptly report unauthorized access to legal@foodie.ma.

3. Invitations and campaigns

Foodie facilitates connections between Creators and Restaurants. Foodie acts as a technical intermediary; each Restaurant decides which profiles to invite or select for its Campaign.

3.1 An invitation is not a guarantee

Opportunities are offered based on the Creator's profile, content quality, reliability, audience, and fit with the Restaurant. An invitation, application, or registration does not guarantee any minimum number of collaborations.

3.2 Campaign terms

Before accepting a Campaign, you must review its terms, including the location, date, invited guest(s), any benefits offered, expected deliverables, required disclosures, any financial compensation, and deadline. By accepting, you agree to comply with those terms.

4. Visits, benefits, and safety

Meals, products, services, or other benefits are provided by the relevant Restaurant under the Campaign terms. They are not cash payments unless the Campaign expressly says otherwise.

  • Follow the communicated schedule, venue rules, and reservation or arrival instructions.
  • If you cannot attend, cancel or notify Foodie and the Restaurant as soon as possible through the stated channel.
  • You are responsible for confirming allergens, dietary restrictions, and visit-related safety information with the Restaurant.
  • Foodie does not operate, control the quality or safety of, or supply food, beverages, or services at partner establishments.

5. Deliverables and transparency

You must create and publish the content required by each Campaign in accordance with its deadlines and instructions. When requested, submit publication links or evidence through the Platform so the Campaign can be monitored.

  • Use the mentions, tags, hashtags, links, and formats required by the Campaign.
  • Clearly disclose the commercial nature of the collaboration, including through Instagram or TikTok branded-content tools and/or labels such as #partnership or #collaboration, as instructed and required by applicable rules.
  • Do not present sponsored content deceptively or conceal its commercial nature.
  • Notify Foodie promptly if you cannot complete a deliverable under the accepted terms.

6. Content rights

You retain intellectual-property ownership of the content you create. Unless the Campaign or a separate agreement states otherwise, you grant Foodie and the relevant Restaurant a nonexclusive, nontransferable license, limited to the Campaign's purpose, to host, access, verify, and repost the content on their organic channels, with creator attribution where reasonably possible.

Any broader commercial use—including paid advertising, whitelisting, print, display, or third-party media—requires a separate agreement specifying at least the channels, duration, and any compensation. You represent that the content is original or properly authorized and does not infringe third-party rights.

7. Integrity and code of conduct

The Foodie Creator Program depends on trust among Creators, Restaurants, and audiences. You agree to act honestly, professionally, and respectfully.

  • Do not falsify your identity, audience, statistics, or results.
  • Do not purchase fake followers, artificial engagement, or other misleading signals.
  • Do not publish illegal, hateful, harassing, discriminatory, dangerous, deceptive, or rights-infringing content.
  • Treat Restaurant staff, other customers, and partners respectfully.
  • Do not bypass Foodie to avoid terms or fees applicable to a collaboration discovered through the Platform.
  • Follow the terms and rules of the social platforms you use.

8. Data and third-party services

With your consent, Foodie may access performance data from your Instagram and TikTok accounts through their official APIs solely to verify eligibility, support matching, measure results, and prepare the Campaign reports described in the Privacy Policy.

You may withdraw this authorization as described in that Policy. Withdrawal may limit features that depend on this data and does not affect processing already performed or legally required retention.

9. Compensation, payments, and taxes

Financial compensation is owed only when expressly stated in a Campaign. Eligibility, verification, and payment conditions are those displayed in the Campaign or communicated by Foodie.

You are solely responsible for tax, reporting, or professional obligations arising from income and benefits received through collaborations. Foodie may withhold or suspend compensation if Campaign terms were not met, verification is required, or fraud is suspected.

10. Suspension and termination

Depending on severity, Foodie may suspend or terminate Program access with or without notice, including for breach of this Agreement or the Terms of Service, fraud, abusive conduct, repeated failure to meet Campaign obligations, prohibited content, or harm to the Platform's or a partner's reputation.

You may request account closure under the Terms of Service. Obligations related to Campaigns already accepted remain in effect until completion or approved cancellation.

11. Availability and liability

Foodie uses reasonable efforts to keep the Platform operating properly. The Platform is provided as available and may be interrupted by maintenance, third-party services, social networks, or events beyond Foodie's control.

Foodie does not guarantee a Campaign, any level of content performance, or any Restaurant business result. To the extent permitted by Moroccan law, the liability limitations in the Terms of Service apply to this Agreement.

12. Changes, governing law, and disputes

Foodie may amend this Agreement to reflect changes to the Platform, law, or social-platform rules. For a material change, Foodie will provide reasonable advance notice by email and/or through the Platform. Continued use after the effective date constitutes acceptance.

This Agreement is governed by Moroccan law. If a dispute is not resolved amicably within thirty (30) days after written notice, the competent courts of Casablanca have exclusive jurisdiction.

14. Community guidelines and moderation

14.1 Scope and acceptance

These rules apply to all content created, published, transmitted, or made available through Foodie, including profiles, messages, comments, reviews, images, videos, offers, and Campaign information (“Community Content”). Before creating or publishing Community Content, you must accept this Agreement, the Terms of Service, and Foodie's applicable rules.

14.2 Prohibited content and conduct

You may not publish, share, request, promote, or use the Platform for:

  • illegal, deceptive, fraudulent, defamatory, threatening, harassing, hateful, discriminatory, violent, or otherwise abusive content;
  • sexually explicit content, exploitation or endangerment of minors, or content that threatens a person's safety;
  • infringement of intellectual-property, image, privacy, confidentiality, or other third-party rights;
  • impersonation, fake reviews, manipulation of statistics or audience, spam, phishing, malware, or attempted unauthorized access;
  • publication of another person's personal information without permission, including contact details, documents, or precise location; or
  • offers, solicitations, or activities that violate applicable law, relevant social-platform rules, or Foodie's safety rules.

14.3 Reporting, blocking, and contact

Foodie provides an in-app mechanism to report content or users that violate these rules and, where direct interaction is available, to block a user. Reports must be submitted in good faith. You may also report a concern to legal@foodie.ma with information that helps us review it.

14.4 Moderation and enforcement

Foodie applies ongoing moderation appropriate to the hosted content. Moderation may occur before or after publication through technical controls and human review. Foodie reviews reports within a reasonable period based on severity, prioritizing safety, minors, and illegal activity.

Foodie may request changes, limit visibility, remove content, restrict a feature, suspend or terminate an account, and report activity to authorities where required or permitted by law. If you believe an action was taken in error, contact legal@foodie.ma.

Acceptance

By creating a Creator account, accepting a Campaign, or using the Platform, you confirm that you have read, understood, and accepted this Foodie Creator End User License Agreement.
