TERMS OF SERVICE
Article 1 – Introduction and Definitions
These Terms of Service govern access to and use of foodie.ma, the related mobile application, and Foodie’s digital tools (the “Platform”). By accessing the Platform or creating an account, you confirm that you have read and accepted these Terms. They are governed by Moroccan law, including Law No. 09-08 on personal data, Law No. 53-05 on electronic exchange of legal data, the Dahir of Obligations and Contracts, and Law No. 31-08 on consumer protection.
“Restaurant” means a food-service business using the Platform to run campaigns. “Creator” means an individual producing social content and registered with Foodie. “Campaign” means a collaboration organized through the Platform. “UGC” means content produced by a creator for a campaign. “Performance Data” means campaign-related social metrics made available through official platform APIs.
Article 2 – Purpose of the Platform
Foodie is a business platform for restaurant influencer marketing in Morocco. It connects restaurants with verified food creators, supports campaign planning and visit coordination, and provides performance reporting and matching tools. Foodie acts as a technology intermediary and does not guarantee a restaurant’s commercial results or independently endorse every statement in creator content.
Article 3 – Registration and Accounts
Restaurant accounts must be created by a legally registered business or authorized representative. Creators must be at least 18 years old and operate in Morocco. Users must provide accurate, complete, and current information and protect their login credentials. Suspected unauthorized access must be reported to legal@foodie.ma.
Article 4 – Instagram and TikTok Data Access
With a creator’s express authorization, Foodie may access account identifiers, follower and growth data, engagement metrics, reach, impressions, aggregated audience demographics, and performance data for Foodie campaigns through official Instagram and TikTok APIs. The data is used only for eligibility review, matching, campaign measurement, and partner reporting. Foodie does not access private messages or platform payment data. Creators may revoke access through Foodie or the relevant social platform; dependent features may then stop working.
Article 5 – Restaurant Responsibilities
Restaurants must provide accurate campaign information, receive assigned creators professionally, respect creators’ moral and intellectual-property rights, pay applicable campaign charges, and use creator performance data only to evaluate campaigns. Restaurants may not bypass Foodie by soliciting matched creators off-platform to avoid fees.
Unless separately agreed, creators retain ownership of UGC. The restaurant receives only the limited, non-exclusive reuse rights stated in the campaign. Paid advertising, print use, or broader commercial exploitation requires the applicable creator agreement.
Article 6 – Creator Responsibilities
Creators must maintain authentic, active, compliant social accounts; deliver agreed content on time; disclose commercial relationships using the tools and labels required by Instagram, TikTok, and applicable law; respect third-party rights; avoid artificial metric manipulation; and report material account changes. Serious violations may result in immediate suspension.
Article 7 – Liability
Foodie uses reasonable efforts to keep the Platform available but is not liable for interruptions caused by maintenance, third-party services, social-platform API changes, force majeure, disputes between users, or campaign outcomes outside Foodie’s reasonable control. To the maximum extent permitted by law, Foodie’s aggregate liability is limited to amounts paid by the affected user during the three months preceding the event giving rise to the claim.
Article 8 – Intellectual Property
The Platform, brand, interface, software, algorithms, texts, and aggregated data are owned by or licensed to Foodie and protected by applicable law. Users may not copy, resell, reverse engineer, or commercially exploit the Platform without prior written permission.
Article 9 – Pricing, Payment, Cancellation, and Refunds
Applicable charges are quoted in Moroccan dirhams and include taxes where stated. Card payments are processed through Payzone; Foodie does not store full card details. An order confirmation is sent after payment.
A customer may cancel without charge before campaign execution begins—that is, before a creator has been matched or committed. Full refunds may be issued for timely pre-launch cancellation, inability to provide the agreed creator scope, duplicate or incorrect billing attributable to Foodie or its processor, or complete non-delivery attributable to Foodie. A proportional refund may apply to undelivered services if a campaign stops for reasons not caused by the customer.
No refund is due for services already delivered, failure to achieve a specific performance result, cancellation after creators have committed, or customer breach. Approved refunds are returned to the original card in the transaction currency. Foodie initiates them within seven business days; the issuing bank may require an additional five to 15 business days. Requests must be sent to legal@foodie.ma with the establishment name, transaction reference, payment date, amount, and reason.
Article 10 – Suspension and Termination
Users may close their account through the Platform. Obligations for active campaigns remain in effect until completion. Foodie may suspend or terminate accounts for material breaches, fraud, abuse, false data, or disclosure-policy violations.
Article 11 – Governing Law and Disputes
These Terms are governed by Moroccan law. The parties will first attempt to resolve disputes in good faith. If no settlement is reached within 30 days after written notice, the courts of Casablanca have jurisdiction, subject to mandatory consumer-law rules.
Article 12 – Changes to These Terms
Foodie may update these Terms. Material changes will be notified through the Platform or by email before taking effect when required. Continued use after the effective date constitutes acceptance.
