PRIVACY POLICY

Article 1 – Data Controller

The controller responsible for personal data collected through the platform is Foodie.ma, Casablanca, Morocco. Data protection contact: legal@foodie.ma. Foodie.ma processes personal data in accordance with Morocco’s Law No. 09-08 and applicable CNDP requirements.

Article 2 – Data We Collect

2.1 Information you provide

Restaurants may provide the legal representative’s name, establishment name and address, business email and phone number, restaurant profile information, and campaign objectives, budgets, and history. Creators may provide their name, email, phone number, city, professional biography, food interests, and payment details needed to receive compensation. Payment information is handled by an approved payment provider and is not stored directly by Foodie.

2.2 Instagram and TikTok data

With a creator’s express authorization, Foodie may obtain through the official Instagram Graph API and TikTok for Business API: account identifiers and usernames; follower, following, and post counts; post engagement, reach, and impressions; aggregated audience demographics; and performance data for content associated with Foodie campaigns. Foodie does not access private messages, payment data held by those platforms, or data not listed here.

2.3 Automatically collected data

We may collect IP address, essential cookie and browsing data, browser and operating-system information, pages viewed, session duration, and actions performed on the platform.

Article 3 – Purposes and Legal Bases

We process data to perform our contract and Terms of Service, including account management, authentication, creator–restaurant matching, campaign operations, performance reporting, and campaign communications. With consent, we may send marketing messages, use non-essential analytics or personalization cookies, and connect to Instagram or TikTok. Our legitimate interests include improving matching, preventing abuse and fraud, and producing aggregated service analytics. Consent may be withdrawn at any time without affecting prior lawful processing.

Article 4 – Data Sharing

During a campaign, a restaurant may see a creator’s social username, aggregated performance and audience data, and campaign content. Direct contact details are not shared without consent. We may use service providers for hosting, transactional communications, payments, analytics, and platform monitoring under confidentiality and data-processing obligations. We do not sell personal data.

Article 5 – International Transfers

Some service providers or social-platform APIs may process data outside Morocco. Where required, Foodie uses appropriate safeguards and completes applicable CNDP formalities.

Article 6 – Retention

Account data is kept while the account is active and then only for the period required by law or to resolve disputes. Campaign and transaction records may be retained for legally required accounting and evidentiary periods. API access tokens are revoked when authorization is withdrawn or an account is closed.

Article 7 – Your Rights

Subject to applicable law, you may request access, correction, objection, deletion, restriction, or portability of your personal data and may withdraw consent. Send requests to legal@foodie.ma with enough information to verify your identity. You may also contact the CNDP at www.cndp.ma.

Article 8 – Security

Foodie applies reasonable technical and organizational measures designed to protect data, including access controls, encrypted transmission where appropriate, secure credential handling, logging, and provider review. No online service can guarantee absolute security.

Article 9 – Platform API Compliance

Foodie uses Meta and TikTok data only for disclosed platform functions, requests only necessary permissions, does not sell API data, honors access revocation and deletion requests, and complies with applicable platform developer terms and reviews.

Article 10 – Changes

We may update this policy. Material changes will be communicated through the platform or by email before they take effect when required.
